Responsibility
The carriers, accommodations, and other suppliers providing services are independent contractors and are not agents, employees, or servants of, or joint venture¡¯s with CANADA WEST GROUND SERVICES INC. or its affiliates. By utilizing the travel services of the Suppliers, you agree that you will look to such Suppliers for any accident, injury, property damage, or personal loss to you or to those traveling with you, and that neither CANADA WEST GROUND SERVICES INC. ?nor any representative of CANADA WEST GROUND SERVICES INC. shall be liable. , CANADA WEST GROUND SERVICES INC. is not responsible for any negligent or willful act or failure to act of any supplier or of any third party. Some tours include visits to shops and merchants. CANADA WEST GROUND SERVICES INC. is not responsible for any purchases you make during your trip, whether that merchant is part of the scheduled itinerary or not. Without limitation, CANADA WEST GROUND SERVICES INC. is not responsible for any injury, loss, or damage to person or property, death, delay, or inconvenience in connection with the provision of, or failure to provide, any goods or services occasioned by or resulting from¡ªbut not limited to¡ªacts of God or force majeure, acts of war or civil unrest, insurrection or revolt, strikes or other labor activities, criminal or terrorist activities of any kind, overbooking or downgrading of accommodations, mechanical or other failure of airplanes of other means of transportation or for the failure of any transportation mechanism to arrive or depart on time, sanitation problems, lack of medical care, snow storms blocking roads, floods, or for any other cause beyond the direct control of CANADA WEST GROUND SERVICES INC.
If, after departure, the services included in the tour cannot be supplied, or there are changes in an itinerary for reasons beyond the control of CANADA WEST GROUND SERVICES INC., CANADA WEST GROUND SERVICES INC. will arrange for the provision of comparable services. Any resulting additional expense will be payable by travelers.
CANADA WEST GROUND SERVICES INC. reserves the right to accept or reject any person as a vacation participant, to expel any participant from the vacation, to make changes in the itinerary whenever CANADA WEST GROUND SERVICES INC. ?deems it necessary for the comfort, convenience, or safety of the participants, and to cancel a vacation at any time. CANADA WEST GROUND SERVICES INC. reserves the right to correct promotional or pricing errors at any time, or to increase the program price in the event of cost increases due to changes in airfares, cruise fares, currency fluctuations, park fee increases, taxes, or fuel surcharges.? Hotels and other accommodations are subject to change.? Every hotel in Canada asks the passenger for a credit card upon arrival in order to facilitate services such as, telephone, minibar, etc.
No person, other than an authorized representative of CANADA WEST GROUND SERVICES INC., by a document in writing, is authorized to vary, add, or waive any term or condition in this website and brochures, including any term or condition set forth in the preceding provisions.
Medical Responsibilities
You must advise us in writing, at or prior to booking, of any physical, emotional or mental condition which may require professional attention during the trip or may require the use of special equipment. If you fail to disclose any such conditions, CANADA WEST GROUND SERVICES INC. may refuse to allow you to take the trip and you will forfeit the trip cost; and in such event we shall have no liability, financial or otherwise.
If you are so challenged, you must bring and be responsible for all necessary items related to your condition. If any such condition arises after the trip is booked, you must advise us in writing immediately. Failure to advise us shall release CANADA WEST GROUND SERVICES INC. and all professional personnel from any liability related to such condition or its treatment.
CANADA WEST GROUND SERVICES INC. is not responsible for the costs of any medical treatment you may require during the trip. Under no circumstances is CANADA WEST GROUND SERVICES INC. responsible for the quality of medical care, or lack thereof, you may receive while on the trip.
